Terms of Service

By using Dayward (“the app”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the app.

1. Description of Service

Dayward is a personal goal-tracking and scheduling app that uses AI to generate session plans, provide coaching, and optimize your weekly schedule. The app is designed for individual, personal use.

2. Account

You must create an account to use Dayward. You are responsible for keeping your login credentials secure. You must provide accurate information when creating your account. You may delete your account at any time from the app’s Settings.

3. Subscriptions and Payments

Dayward offers a free trial and paid subscription plans (monthly and yearly) through Apple’s App Store. By subscribing, you agree to the following:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds are handled by Apple according to their refund policy.

4. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose.
• Attempt to reverse-engineer, exploit, or bypass security measures of the app or its backend services.
• Abuse the AI features (e.g., using the mentor chat for purposes unrelated to goal coaching, or attempting to circumvent rate limits).
• Share your account credentials with others or create multiple accounts to abuse free trials.
• Use automated scripts or bots to interact with the app.

5. AI-Generated Content

Dayward uses AI (powered by Anthropic’s Claude) to generate session plans, coaching advice, goal assessments, and weekly reviews. This content is generated automatically and is not professional advice. Specifically:

• AI-generated plans are suggestions, not obligations. You are responsible for your own schedule and decisions.
• The AI mentor is not a substitute for professional coaching, medical advice, therapy, or any licensed professional service.
• AI outputs may occasionally be inaccurate or unhelpful. Use your own judgment.

6. Your Content

You retain ownership of all content you create in the app (goals, journal entries, reflections, messages). By using the app, you grant us a limited license to process this content for the purpose of providing the service (e.g., sending it to the AI for session plan generation).

We do not claim ownership of your content and will not use it for purposes other than providing and improving the service for you.

7. Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Availability and Changes

We strive to keep Dayward available and reliable, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify you of significant changes.

9. Limitation of Liability

To the maximum extent permitted by law, Dayward and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. This includes, but is not limited to, damages for loss of data, missed scheduling, or reliance on AI-generated content.

Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The app is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the app if you violate these Terms. You may stop using the app and delete your account at any time. Upon termination, your right to use the app ceases immediately.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance. We will notify you of material changes through the app.
